FAQs:
A: In order to file for divorce you must have been married for at least 12 months and you must have your original marriage certificate or obtain a certified copy from the Registrar. If your divorce involves substantial financial assets and/or potential disagreement about arrangements for children, you should seek legal advice at an early stage.
A: Since April 2022, divorce is now a no fault based process and there is only one ground for divorce in England and Wales and that is the irretrievable breakdown of the marriage.
A: From filing your application to obtaining your Conditional Order of Divorce (previously Decree Nisi) takes 26 weeks.. Once you have your Conditional Order you must wait for a period of at least 6 weeks and 1 day before you can apply for your Final Order of Divorce (previously Decree Absolute) to formally end the marriage. However it may be advisable in some cases not to apply for the Final Order until the division of finances has been resolved and a binding Order is in place.
